1. Acceptance of these Terms

By accessing or using this website, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the site. This website is operated by Peters Industry Training & Consulting LLC, doing business as PITCO Engineering, a for-profit industrial automation engineering company organized under the laws of the State of West Virginia, United States, with a mailing address in Dayton, Tennessee.

You may use the site for lawful purposes and in accordance with these Terms. You agree not to:

The site and its contents — including text, graphics, logos, the PITCO and AEOS names and marks, images, and software — are owned by or licensed to PITCO and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the site for your own informational and business purposes. All rights not expressly granted are reserved. You may not use our names, logos, or marks without our prior written permission.

5. Your submissions

When you submit information through our forms (for example, contact requests, assessment requests, waitlist sign-ups, or job applications), you represent that the information is accurate and that you have the right to provide it. You grant PITCO the right to use the information you submit to respond to you and operate our business, consistent with our Privacy Policy. Do not submit confidential information through the site unless we have agreed in writing to receive it.

6. Information, not engineering advice

The content on this site is provided for general informational purposes about PITCO and its services. It is not engineering, technical, legal, or professional advice, and it does not create any engagement or professional relationship. Any engineering services we provide are governed by a separate written agreement between you and PITCO; in the event of a conflict, that agreement controls with respect to those services.

8. Disclaimers

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PITCO disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site will be uninterrupted, secure, accurate, or error-free. 9. Limitation of liability

To the fullest extent permitted by law, PITCO and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or related to the site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to indemnify and hold harmless PITCO and its officers, members, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the site or your violation of these Terms or applicable law.

12. Governing law & disputes

These Terms are governed by the laws of the State of West Virginia, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the site will be subject to the exclusive jurisdiction of the state and federal courts located in West Virginia, and you consent to personal jurisdiction and venue there, except where applicable law gives you the right to bring a claim elsewhere.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Changes are effective when posted, and your continued use of the site means you accept the updated Terms.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and any separate written agreement you have with us, are the entire agreement between you and PITCO regarding the site. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
